Kansas’ enhanced Move Over law requires drivers to move over and slow down when passing vehicles on the roadside that are displaying flashing lights. This includes first responders, tow trucks and construction workers, but also includes disabled vehicles and other instances when hazard warning lights are displayed. Road flares, caution signals and traffic cones should also prompt drivers to slow down and move over.
Drivers on highways that have two or more lanes heading in the same direction should change lanes, if possible, to give additional space for the vehicle displaying hazard lights to operate. This provides an added layer of protection for individuals who may be in an emergency situation on the roadside. For highways with only one lane in each direction, drivers should slow down when approaching a vehicle with flashing lights and move over only if safe to do so.
